Terms and Conditions

These terms and conditions govern all dealings between Wermod and Wermod Publishing Group (‘us’) and its customers and apply to all customers, including retail customers, bulk customers, distributors, and libraries (unless otherwise stated herein or agreed). The provisions relating to Our Intellectual Property Rights, Privacy, Frustration, and Jurisdiction apply to all dealings between Wermod and Wermod Publishing Group and any third parties.

The Contract
Your order (and not the items on our website) constitutes an offer. Our confirmation of your order constitutes our acceptance of your offer. A contract between us and you is created when you receive the confirmation. With orders not made through our website our contract comes into being once we have accepted your order, usually by email. If one or more items ordered are not in stock at the time of your order the contract will be deemed not to include those items, but will still exist in relation to such items as are available, which we may ship to you provided we refund the part of the shipping charges relating to the unavailable items. We may (at our discretion) contact you for further instructions in such circumstances, in which case you will have the right to cancel or amend you order. 

If the price of an item is different from the price displayed on our website we will charge the lower price (if the actual price is lower than the price on our website), or contact you for instructions (if the actual price is higher than the price on our website).

We will be deemed to have fulfilled our part of the contract once the items ordered by you have been entrusted with a reasonable shipper; we will not liable for any loss or damage during transit.

All our orders are shipped from the United Kingdom within 48 hours of receipt. We ship worldwide. Delivery times depend on the destination and chosen shipping method.

If you are a retail customer you may return any items purchased from us within fourteen days of receipt. We will refund your order within thirty days, provided the goods we receive from you are in the same condition as they were when we sent them to you. Such refund excludes the shipping and handling fee you initially paid for having the order dispatched to you, and you will have to pay the cost of sending it back to us. Please email us if you wish to return an item, and we will send you further instructions.

If you wish to make a return because the goods you purchased are defective or otherwise of substandard quality then you will have the option of either having replacement goods sent to you or a full refund, which includes the money you paid in postage to and from you. This, however, is on the condition that upon receipt of the defective goods we agree that they are indeed defective or below the standards a customer purchasing an item from us could reasonably expect. Generally, we issue a refund if the item has some significant flaw, but not if the perceived defect is trifling.

If you are a retail customer residing within the European Union you have a statutory seven-day ‘cooling off period’ in addition to your fourteen-day right of return. This means you can return the goods within twenty-one days of receipt.

If you are a business customer you have no right of return, unless such a right has been expressly agreed to by us in writing (‘in writing’ includes email). You are a ‘retail customer’ if you are considered a ‘consumer’ under the Sale of Goods Act 1979, as amended. Otherwise, you will be deemed to be a business customer.

Exclusion of liability
We shall not be liable in damages for any losses (whether direct or indirect, financial or otherwise) caused by late delivery, defective products or any other circumstance. (For the avoidance of doubt, you may have any defective products replaced as per the provisions concerning returns, shown above.)

If you make an order with us we will assume that you consent to receiving newsletters detailing Wermod and Wermod Publishing Group-related news, additions to our catalogue, special offers, and so forth. If at any time you request that we stop sending you newsletters we will remove your email address from our newsletter list.

Intellectual Property
We have the exclusive right to the content of our website. Nothing found on our web-site may be used for such purposes as would be contrary to our copyright ownership, including copying as well as other illegitimate use of any items, descriptions, texts (other than book descriptions not covered by copyright), images, logos, trade names, and any other intellectual property on our website.

We reserve the right to amend these Terms and Conditions as we see fit and at any time. We will not be liable for events beyond our control, such as, for example, delayed deliveries, strikes, mistakes made by the postal service, interference by customs, theft, or the like. If we have a right to do something but do not make use of that right we shall not be deemed to have waived the said right.

These terms and conditions and all dealings between us and you shall be subject to the laws of England and Wales, unless otherwise agreed. Any disputes shall be decided by the Guildford County Court or, if the matter in dispute falls outside its jurisdiction, the appropriate court nearest to it. Major disputes may (at our discretion) be conducted in Her Majesty’s High Court of Justice at the Strand in London. Minor disputes may (at our discretion) be conducted through www.moneyclaim.gov.uk.

We accept all major credit and debit cards, as well as cheques and postal orders (made payable to "Wermod and Wermod").
